1. Who we are

These Terms & Conditions ("Terms") govern your access to and use of the KinesioCore service (the "Service"), provided by KinesioCore ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

2. Acceptance

By accessing, registering for, or continuing to use the Service, you confirm you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction to enter into this agreement.

3. The Service

KinesioCore provides an online question bank, study tools, mock exams, and AI tutoring for physiotherapy students. We may add, modify, or remove features at any time.

4. Accounts

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. Acceptable use

You must not:

• use the Service for any unlawful purpose, fraud, or spam;
• infringe the intellectual property or other rights of any party;
• upload malware, attempt to gain unauthorised access, probe, scan, or test the vulnerability of the Service, or otherwise interfere with its security;
• scrape, copy, or redistribute Service content beyond personal study use;
• reverse engineer, decompile, or attempt to derive the source code of the Service;
• resell, sublicense, or share your account.

6. Intellectual property

The Service, including all question content, explanations, software, branding, and documentation, is owned by KinesioCore or its licensors and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal study within the plan you have selected.

7. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period unless cancelled.

9. AI features

The Service includes AI-generated explanations and tutoring. AI outputs may be inaccurate or incomplete and are provided for educational purposes only. They are not a substitute for clinical judgment, professional medical advice, or qualified instruction. You are responsible for your prompts, how you use the outputs, and verifying accuracy. You must not use the AI features to generate unlawful, harmful, or infringing content.

10. Disclaimer of warranties

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or suitable for exam success.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability to you arising out of or in connection with the Service is limited to the fees you paid in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is prohibited by law.

12. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete your data after a reasonable export window.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app notice. Continued use after the effective date constitutes acceptance.
